AI Content Policy
How generated images work, what rights you have in them, and their limits.
Last updated 25 October 2026
1. How images are made
Every image Exbrush generates or edits is produced by an AI model built by a third party. Each studio and tool uses the model that suits it, and we change models as better ones appear. The same prompt can give a different image each time, and may give a different one after a model changes.
2. Your rights in what you make
We claim no ownership of your images and assign to you any rights we would otherwise hold, as set out in the Terms of Service. You can publish, sell and otherwise use them commercially, with no watermark and no attribution to us.
3. The limits of those rights
- Copyright in AI images is unsettled. In some countries an image made mostly by a model cannot be protected by copyright at all, or only the parts a person contributed can. We cannot promise that you will be able to stop others copying an image you generated.
- Images are not unique. Another person using a similar prompt may get a similar image, and has the same rights in theirs as you have in yours.
- An image may resemble existing work. Models learn from large collections of images and can produce something close to an existing artwork, character or brand. Check before you rely on an image for something important.
- Logos and icons need a trademark check. A generated mark has not been searched against existing trademarks. Do that search, or have a professional do it, before you register or build a brand on one.
4. Accuracy
Models make mistakes. Text inside an image can be misspelt, hands and objects can be wrong, and an image of a real place, product or person may not be accurate. Do not treat a generated image as evidence of anything, and review every image before you use it.
5. Content checks
Prompts and images are checked automatically against the Acceptable Use Policy. A run may be declined, and occasionally a harmless one is declined by mistake. A declined run is not charged. If a tool keeps refusing something you believe is allowed, tell us.
6. Telling people an image is AI-made
We do not add a visible watermark. Some laws and some platforms require AI-generated or AI-edited images to be labelled, especially realistic images of people or events. It is your responsibility to label an image wherever that is required, and never to present a generated image as a real photograph in a way that misleads.
7. Training
We do not use your prompts, uploads or generated images to train AI models. See the Privacy Policy for how the model providers are sent your content.
8. Your responsibility
You decide what to make and where to use it, and you are responsible for both. If you have a question about an image or this policy, write to support@exbrush.com.
