Terms of Service

The agreement between you and Exbrush: accounts, credits, and who owns what.

Last updated 25 October 2026

1. The agreement

Exbrush is an AI image generator and editor operated by [legal entity name] (“we”, “us”). These terms, together with the policies they link to, are the agreement between you and us. By creating an account or using the service you accept them. If you do not accept them, do not use the service.

You must be at least 13 years old to use Exbrush. If you are under the age of majority where you live, you need a parent or guardian’s permission, and they accept these terms on your behalf. If you use the service for a company, you confirm you are allowed to accept these terms for it.

2. Your account

You sign in with a Google or GitHub account; there are no Exbrush passwords. You are responsible for keeping that provider account secure and for everything done through your Exbrush account. An account is for one person and may not be shared, sold or transferred.

Tell us straight away at support@exbrush.com if you think someone else has used your account.

3. Credits and payment

Everything that runs a model is paid for in credits. A new account starts with 20 credits. After that, credits are bought in one-off payments of $5 to $100 through PayPal, at 4¢ a credit. There is no subscription: nothing renews and there is nothing to cancel.

  • A photo or illustration costs 2 credits, and a logo or icon costs 1.5, whether it is generated or edited. The current rates are always on the pricing page.
  • Credits do not expire.
  • Credits are not money. They have no cash value, cannot be transferred to another account, and can only be spent inside Exbrush.
  • A run that fails gives its credits back automatically. A batch that succeeds in part is refunded for the part that failed.
  • We may change prices and rates. A change applies to purchases and runs made after it, never to credits you have already spent.

Refunds of purchases are covered by the Refund Policy.

4. What you put in

You keep ownership of everything you give the service: prompts, uploaded images, reference images and sketches. You give us permission to store, copy, process and send that material to the model providers we use, only as far as needed to run the service for you.

You confirm that you have the rights to everything you upload, including the consent of any person who appears in it, and that using it with Exbrush breaks no law and no one else’s rights.

5. What you make

As between you and us, the images you generate and edit are yours. We claim no ownership of them and, as far as the law allows, we assign to you any rights we would otherwise hold in them. You may use them for any lawful purpose, including commercially, with no watermark and no further payment to us.

That is a promise about our rights, not a guarantee about anyone else’s. Whether an AI-generated image can be protected by copyright, and whether it resembles existing work, depends on the image and on the law where you are. The AI Content Policy explains the limits, and you are responsible for how you use what you make.

6. Rules of use

You agree to follow the Acceptable Use Policy. It is part of these terms.

7. Our service

The Exbrush app, its design, its name and logo, and the built-in styles and presets are ours or our licensors’. These terms give you a personal, non-exclusive right to use the service; they do not give you any right to copy it, resell access to it, or use our name or logo as your own.

8. Services we rely on

Images are produced by third-party AI models, payments are handled by PayPal, and the service is hosted on third-party infrastructure. We choose these providers with care but do not control them. The models behind a tool may be changed or replaced at any time, and the same prompt may not give the same result later.

9. Changes and availability

We may add, change or remove features, and we may interrupt the service for maintenance or for reasons outside our control. We do not promise that the service will always be available or free of errors. Keep your own copies of images that matter to you.

10. Suspension and closing an account

You can stop using Exbrush at any time, and you can delete your account yourself under Settings → Account. Deleting it removes your images and any unused credits for good; it cannot be undone. You can also ask us to do it by writing to support@exbrush.com.

We may suspend or close an account that breaks these terms or the Acceptable Use Policy, that puts the service or other people at risk, or where the law requires it. Credits on an account closed for a serious breach are forfeited. If we close an account for any other reason, or shut the service down, we will refund purchased credits that have not been spent.

11. No warranty

The service and everything it produces are provided “as is” and “as available”. As far as the law allows, we give no warranty of any kind, including that outputs will be accurate, original, fit for a particular purpose, or free of other people’s rights.

12. Limit of liability

As far as the law allows, we are not liable for indirect or consequential loss, or for lost profit, revenue, data or goodwill. Our total liability to you for anything arising from the service is limited to the amount you paid us in the twelve months before the claim arose.

Nothing in these terms limits liability that cannot be limited by law, or takes away rights you have as a consumer where you live.

13. Your responsibility to us

If someone brings a claim against us because of content you uploaded, images you made, or your breach of these terms, you agree to cover the reasonable costs and losses that result, as far as the law allows.

14. Governing law

These terms are governed by the laws of [country or state], and its courts hear any dispute about them, unless the consumer law where you live gives you the right to something else.

15. Changes to these terms

We may update these terms. The date at the top shows the latest version. If a change is significant we will tell you in the app or by email before it takes effect. Using the service after a change means you accept the new terms.
